These Terms and Conditions govern your use of Anthemist and the services offered through this website. By accessing or using Anthemist, you agree to these Terms.

1. Acceptance of Terms

1.1. These Terms form a legally binding agreement between you and ANNA ESEN LLC ("Anthemist", "we", "us", "our").

1.2. If you do not agree to these Terms, you must not use Anthemist.

1.3. Our Privacy Policy is part of how Anthemist operates. By using Anthemist, you acknowledge the Privacy Policy in addition to these Terms.

2. Eligibility and Account Use

2.1. You must be at least 16 years old to use Anthemist.

2.2. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

2.3. You must provide accurate and complete information when creating an account or submitting journey data.

3. Service Description

3.1. Anthemist provides a personalized creative service that generates anthem-related content based on your submissions.

3.2. Output quality and artistic style are subjective by nature. We do not guarantee that generated results will match every personal preference.

3.3. We may update, modify, suspend, or discontinue parts of the service from time to time.

4. User Content and Rights

4.1. You retain ownership of content and data you submit to Anthemist.

4.2. You grant us a non-exclusive license to process your submitted content as required to operate, improve, and support Anthemist.

4.3. You confirm you have all required rights and permissions for content you submit.

4.4. You must not submit content that is unlawful, hateful, harassing, defamatory, sexually explicit, discriminatory, threatening, or otherwise offensive, profane, or disrespectful. We may screen submissions for such content, and we may reject or remove any submission that breaches these standards.

5. Payments and Checkout

5.1. Paid services are shown at checkout. Prices may change before purchase but do not retroactively affect completed purchases.

5.2. Payments are processed by third-party providers, including Stripe. We do not store full payment card numbers on our servers.

5.3. You authorize the payment provider to charge the amount shown at checkout.

6. Refunds

6.1. For website purchases, a refund request may be submitted within 7 days after the initial successful payment.

6.2. Refund eligibility may be reduced or denied where digital services have already been fully delivered, where abuse is detected, or where law permits non-refundable digital delivery.

6.3. Once a personalized anthem package has been fully delivered and accepted, refunds are generally no longer available except where required by law.

6.4. Where a submission is rejected because it violates the content standards in Section 4 or Section 7, the order is treated as ineligible for a refund to the fullest extent permitted by law.

7. Acceptable Use Restrictions

You agree not to:

• misuse Anthemist for unlawful, fraudulent, or unauthorized purposes;
• submit or request content that is profane, obscene, hateful, harassing, discriminatory, defamatory, sexually explicit, violent, or otherwise offensive or disrespectful;
• submit content that is illegal or promotes illegal activity;
• attempt to gain unauthorized access to systems, data, or accounts;
• interfere with security, stability, or availability of Anthemist;
• reverse engineer, decompile, disassemble, or scrape protected service components;
• upload malware or harmful code;
• use automated tools to access the service in a way that creates abuse, excessive load, or operational risk;
• infringe third-party rights, including intellectual property and privacy rights.

8. Intellectual Property

8.1. Anthemist software, branding, and platform components are owned by ANNA ESEN LLC or its licensors and are protected by applicable law.

8.2. Except where expressly allowed, you may not copy, redistribute, or create derivative works from protected Anthemist platform materials.

9. Disclaimers

9.1. Anthemist is provided on an "as is" and "as available" basis.

9.2. To the fullest extent permitted by law, we disclaim warranties of uninterrupted availability, error-free operation, merchantability, fitness for a particular purpose, and non-infringement.

9.3. We do not guarantee specific business, emotional, artistic, or commercial outcomes from use of Anthemist.

10. Limitation of Liability

10.1. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.

10.2. Our aggregate liability arising out of or related to Anthemist is limited to the amounts you paid to us for the relevant service giving rise to the claim.

10.3. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Suspension and Termination

11.1. We may suspend or terminate access if you breach these Terms, create security risk, or misuse the service.

11.2. You may stop using Anthemist at any time.

12. Changes to Terms

12.1. We may update these Terms from time to time.

12.2. Material updates will be reflected by the "Last updated" date. Continued use after updates means you accept the revised Terms.

13. Governing Law

These Terms are governed by applicable laws of the United States and the State of Florida, without prejudice to mandatory consumer protections in your jurisdiction.
